The government interfered in the reform of inheritance law

The Ministry developed amendments to the draft law, allowing married couple to make joint wills and create personal funds.

The government of the Russian Federation has developed amendments to the bill, which foresees the reform of inheritance law in Russia. The Ministry believes that the document lacks the anti-corruption component, and proposes to strengthen the protection of citizens, the right to an obligatory share in the inheritance.

 

 

 

The government's proposal to exclude commercial organizations from the list of beneficiaries of the fund is quite logical, believes the attorney of the National Law Company “Mitra”, Alina Zelenskaya.

- Amendments to the law on combating corruption in terms of the inability to give instructions to the trustee are aimed at combating "pocket personal funds". But the third party, including a relative, can become the beneficiary. It seems that additional legislative changes are needed, "she said.

- The amendment for three years protects heirs who are entitled to an obligatory share, from situations when the inherited property was taken out to the fund. On the other hand, the contest takes place in court and is a costly process for the party, "Alina Zelenskaya noted.
