The agreements of marriage are popular in Russia, but, not all people know about conditions of such agreements. Practice shows that even notaries certify illegal contracts. On the example of the case in the Supreme Court, "Pravo.ru" explains what rights and duties of the married couple can be included in the marriage agreements. And the experts explain the tricky situation - is it possible, for example, to envisage in the "family contract" the frequency of meetings with the mother-in-law or compensation for treason.
Experts have some questions for the specialists about this document. Galina Pavlova, managing partner of Pavlova & Partners, the head of the family and inheritance law, explains that agreements of marriage with "extremely unfavorable" conditions are being "sifted out" from the notary: "It is therefore surprising that the agreement from the case under discussion was generally certified" Alina Zelenskaya, the lawyer of the National Law Company “Mitra”, agrees with her colleague, recalls that the Supreme Court almost 20 years ago interpreted the "extremely unfavorable situation" (Decree of the Plenum of the Supreme Soviet of November 5, 1998, No. 15).
