He added that this idea does not cancel the 214-FL.
Another changing in legislation that can seriously affect the development market is the transition to the calculation of property taxes on the cadastral value of real estate. The head of the cadastral valuation department of the Territorial Department of Property Relations Vadim Labutin told the developers that at the moment the regional law has not yet been adopted. According to preliminary plans of the administration of the region since 2017 to calculate the property tax at the cadastral value will be transferred to an area of more than 5 thousand square meters, from 2018 - over 3 thousand square meters, from 2019 onwards - over 1 thousand square meters.
At the same time, cadastral valuation of objects is already now. Cases where the cadastral value is different from the market value is not uncommon in the region. Lyubov Anisimova, Chairman of the Krasnodar Regional Society of Appraisers, noted that there are cases when a tax calculated at the cadastral value can be several times higher than the object calculated at the inventory price.
Despite the opinion that it is difficult to challenge such a situation, up to 88% of disputes in the Krasnodar region end in favor of the applicants even at the stage of consideration by the Rosreestr commission in pre-litigation stage. "The commission of Rosreestr has been working since 2012. During this time, we reviewed 2.8 thousand applications for review of the cadastral valuation and 2,500 of them received new cadastral passports. The percentage of positive decisions reaches 88%, "commented Andrey Mamontov, deputy head of the regional department of the Federal Service for State Registration, Cadastre and Cartography. However, Djakov said that based on his practice of litigation, courts still more often deny the claims of land owners.
