Many people imagine the process of receiving inheritance in such form: in the luxure room with sad relatives, friends and colleagues the notary officer solemnly opens a letter and announces the last will of decendent. Someone becomes a rich man, but someone comes away none the wiser. Such situation from films has neither part nor lot in real life.
When can you open and receive inheritance?
You can open the inheritance from the day of death of the testator, but take it within six months from the date of death (clause 1, article 1152, clause 1, article 1154 of the Civil Code). If the right of inheritance arises for other persons as a result of the heir's renunciation of the inheritance or the removal of the heir, such persons may accept the inheritance within six months from the date on which they inherit the right of inheritance. Persons for whom the right of inheritance arises only because of the non-acceptance of the inheritance by another heir may take the inheritance within nine months from the date of the death of the testator. Attorney of the National Law Company "Mitra" Alina Zelenskaya explained: the term of acceptance inheritance expires in the last month of the term on the same day as the opening of the inheritance.
