The general contractor of construction of TLC “Yuzhnouralsky” is required to be declared bankrupt due to a debt of 8.4 billion rubles
The meeting of creditors of OJSC “Eneks” appealed to the regional arbitration, demanding to recognize the company as bankrupt and to enter bankruptcy proceedings. The total amount of claims - 8.4 billion rubles. Of these, 8.3 billion rubles. - obligations to Gazprombank, which owns 75% of Eneks' shares. Among the reasons for the financial problems, the company's management calls participation in the construction of the “Yuzhnouralsky” transport and logistics complex as a general contractor, but the temporary manager found signs of deliberate bankruptcy in the actions of the “Eneks” management. According to experts, whether the company will be able to pay off its creditors will in many respects depend on the results of the criminal investigation initiated by the appeal of the temporary manager.
The executive director of National Law Company “Mitra” Zaurbek Akhmetov told Kommersant that the ability of “Eneks” to settle accounts with creditors will largely depend on the results of investigation of the facts of deliberate bankruptcy. "The interim manager will give his opinion to the law enforcement agencies, and if violations of the law are found, then the head of “Eneks and also the shareholders and / or the board of directors, can be brought to criminal responsibility, if they had to this attitude. After that, “Eneks” will be able to apply to them for damages. In addition, in the event of insufficiency of the debtor's property, the guilty will bear subsidiary responsibility for its obligations to creditors, "the expert explained. According to him, while it is difficult to say whether this will help pay off the debt, it depends on the amount of damage and the current solvency of persons who will be brought to justice.
