In regard to the Kuban “Eneks”, 75% of which are owned by Gazprombank, a monitoring procedure has been introduced. The company is the general contractor of the construction of the transport and logistics complex "Yuzhnouralsky", which is conducted with the money of private investors in the Chelyabinsk region. With a claim for the recognition of the company bankrupt, her subcontractor applied to whom “Eneks” owed about 45 million rubles. At the same time, the company assures that it will pay off its creditors as soon as the developer finishes construction of the TLK – “Resurs” - 840 million rubles. Meanwhile, Resource itself is on the verge of bankruptcy. According to some analysts, the state could unleash a debt node and save “Eneks” from bankruptcy. According to others, in the current economic conditions this is unlikely.
The Arbitration Court of the Krasnodar region introduced a monitoring procedure for the general contractor of the transport and logistics complex "Yuzhnouralsky" - "Eneks". With a request to declare the company bankrupt in October 2016, the subcontractor of the construction of the TLK - "RealService" applied to arbitration. In November 2016, the right to claim the debt was transferred to “Arkada”. According to the case materials, the amount of claims is 45.79 million rubles. The observation was introduced until August 2, 2017.
The transport and logistics complex “Yuzhnouralsky”, being built in the Chelyabinsk region, is part of the New Silk Road, which was to open the way for Chinese investors to Russia and Europe through Kazakhstan. In 2015, the first turn of the TLK was launched. "Yuzhnouralsky" occupies 180 hectares and is a railway container terminal, warehouses for 82 thousand square meters with the prospect of increasing to 450 thousand square meters. The cost of the project, implemented with the funds of private investors, is estimated at 6.8 billion rubles. According to investors' plans, the terminal will be able to receive 2.5 million tons of cargo per year with the prospect of increasing the volume fourfold.
"Eneks", according to its own information, performs a full range of design, installation and commissioning works "turn-key ready" in the construction, reconstruction and operation of power facilities. According with “Kartoteka.ru”, the main activity is the production of electricity. The owner of 75% of the company's shares is “Areex”, 100% owned by Gazprombank, and 25% owned by Management of Southern Energy Information Center. At the end of 2015, the balance of “Eneks” amounted to about 14.6 billion rubles, revenue - more than 8 billion rubles., Profit - 1.4 billion rubles., Net profit - 16.2 million rubles. According with the SPARK-Interfax system, the company's short-term accounts payable is 1.89 billion rubles, the volume of long-term accounts payable is 190.7 million rubles. In the arbitration courts of Moscow and the Krasnodar region as a debtor "Eneks" was a defendant of five cases of bankruptcy. Of these, by the present moment, two proceedings have been stopped.
The executive director of the National Law Company” Mitra” Zaurbek Akhmetov, considers that “Eneks” bankruptcy case is untypical. "It is strange that a creditor with 45 million claims could introduce a monitoring procedure. Many companies with a worse financial position continue to work for many years and avoid it. " The management of the company, in his opinion, should have objected to the introduction of surveillance and to find means to satisfy the creditor's claims. "Before the observation, it was possible to negotiate individually with each on repayment or debt restructuring. Now you can exit the procedure only by paying off the claims of all creditors. That is, the task has seriously become more complicated, "the expert said. As follows from the materials of the case, at the moment 11 companies have filed their claims to “Eneks”.
