In free time a lawyer is a lawyer, and he can`t ignore bad agreement or put up with violation of consumer's rights. But there is an exclusion, when the spent time and effort are not equal the money that can be returned in case of successful resolution of the dispute. “Pravo.ru” asked lawyers about their reaction on the violations of law in their free time. Do they require to make amendments to the contract, are they involved in the negotiations, are they being appealed to the courts? Do they have a successful experience of protecting their own rights?
The CEO of the National Law Company “Mitra” Yury Mirzoev:
I try not to dispute, because my time is more expensive. I pay penalties. In the consumer disputes I always try to make an agreement. Perhaps, I good explain to sellers about all consequences or financial costs in the court.
The exceptions are tax disputes. Maybe it`s impact of tax practice, where I`m a head. Here I always appeal all illegal decisions. For example, there were situations with my relatives and friends, where tax authorities didn`t return tax rebate for buying apartment. After the filed my complaint to the higher tax authority, the money arrived on the card one week later.
