The 18th of April 2016 year in the Arbitration court of North Caucasus District a big tax dispute was finished in favor taxpayer. Should remember, that the largest in our region producer glassware “Kavminsteklo” filed a lawsuit against tax authority with cancellation decision about additional charge of VAT, income tax, penalty and fine. Tax dispute were conducting in some instances. The court of the first instance made decision to dismiss a claim, but appeal instance cancelled tax authority`s decision in full. But it was not the end. Tax authority petitioned the cassation instance.
Due to efforts and knowledge of the heads National Law Company “Mitra” Yury Mirzoev and Zaurbek Ahmetov this tax dispute in cassation instance was conducted in favor of company “Kavminsteklo”. In the result the decision of the 16 AAC was left inalterably and cassation claim of tax authority was dismissed.
This tax dispute became important for forming practice for disputes linked with appropriation defect production on charges in glassware industry; and was given publicity as precedent-setting experience on the website of “Kommersant”.
